PRESS RELEASE: OMB Shuts Down Operations of Store in Cainta, Confiscating Php 8M Worth of Computers
A follow up operation against Kwan Merchandise, a business establishment located at Brgy. Sto. NiƱo, Cainta, Rizal, was conducted by agents of the Optical Media Board.   In a report submitted the Enforcement and Investigation Division of the OMB, said establishment was already reminded to renew its expired OMB license last September 22, 2020. However, upon inspection yesterday, October 29, 2020, personnel of Kwan Merchandise failed to present a valid OMB license. Pursuant to the Implementing Rules and Regulations of Republic Act No. 9239 otherwise known as the Optical Media Act of 2003, an administrative sanction such as the closure of establishment shall be imposed upon establishments who engage in the sale of storage devices without registering with and/or securing a license from the OMB, or fails to renew an expired license within thirty (30) days from the date of expiration (Section3, Rule 1, Title V).   Seized from the establishment are 195 units of brand new laptop computers, 8 desktop computers and 2 CPUs with an estimated total value of Php 8,100,000.00.   The owners of Kwan Merchandise are facing administrative and criminal charges for violations of Republic Act No. 9239. If found guilty, the people responsible for this act will face maximum imprisonment of up to six (6) years and a fine of up to One Million Five Hundred Thousand Pesos (Php 1,500,000.00) per violation. #
