MC-2005-07: Guidelines Relating to Recordable CDs

MEMORANDUM CIRCULAR NO. 2005-007
GUIDELINES RELATING TO RECORDABLE CD’S

1. Policy on Recordable CDs – Recordable discs, being suitable for the manufacture of optical media, are hereby classified as “manufacturing materials.”

2. Registration and Licensing – All entities engaged in the importation, exportation, production, distribution and wholesale and retail sale of recordable discs, such as, but not limited to CD-R, CD-RW, DVD-R, etc…, are hereby required to register and obtain a license to engage in an optical media business.

3. Presumption – All commercially-offered burned optical media, or recordable discs on which copyrighted material has been recorded shall be presumed to be in violation of Sec. 19(a) (3) of Republic Act No. 9239 in relation to Title IV, Rule 1, Section 1(c) of the Implementing Rules and Regulations thereof, unless covered by a Commercial Replication Permit;

4. Effectivity. – This Circular shall take effect immediately.
